Criminal case against a Pentecostal in Asbest

On July 31, 2013, it became known that the Investigative Committee for Sverdlovsk Oblast had opened a criminal case under Article 282 of the Criminal Code (incitement of hatred or enmity, as well as humiliation of human dignity) regarding the posting of publications in the blog of Pyotr Tkalich, a Pentecostal from Asbest.

The criminal case involves two texts published by Tkalich in 2006 – “The Boiling Cauldron” and “The Boiling Cauldron – 2.” Both contain criticism of the Patriarch and the positions of modern Orthodox believers, but they do not contain any calls for unlawful actions. Recall that, according to the Resolution of the Plenum of the Supreme Court of the Russian Federation No. 11 “On Judicial Practice in Criminal Cases Concerning Crimes of Extremist Nature” of 2011, “criticism of political organizations, ideological and religious associations, political, ideological or religious convictions, national or religious customs should not in itself be considered as an action aimed at inciting hatred or enmity.”

The case was opened based on the results of a check conducted by the FSB. The first search in the case took place at the home of Pyotr Tkalich and his wife Olga on May 21, 2013; investigators seized a system unit, a laptop, several Christian books, as well as a collection of articles by Andrei Piontkovsky “For the Motherland, for Abramovich, Fire!” and the book by Elena Tregubova “Tales of a Kremlin Digger.”

On July 31, 2013, the family was questioned as witnesses. The investigator of the Investigation Department for Asbest of the Investigative Directorate of the Investigative Committee for Sverdlovsk Oblast informed Tkalich that three expert examinations had been ordered — a computer forensic examination of the seized digital media, and two linguistic examinations of the seized books and the texts “The Boiling Cauldron” and “The Boiling Cauldron – 2.” The results will be known in early 2014.

It should be noted that the Investigative Directorate of the Investigative Committee for Sverdlovsk Oblast claims that the case was opened not because of the two texts mentioned, but because of other publications in Tkalich’s blog, which is inconsistent with the data of the lawyers of the Interregional Human Rights Association “Agora,” representing Tkalich’s interests.
